2. Services Provided

CollectRefund provides unclaimed property recovery services, including:

• Identification of unclaimed property held by government agencies
• Research and verification of ownership and eligibility
• Preparation and submission of recovery claims
• Communication with state and federal agencies on your behalf
• Processing and remittance of recovered funds

3. Client Obligations

As a client, you agree to:

• Provide accurate and truthful information
• Submit required documentation in a timely manner
• Respond to communications regarding your claim
• Not engage with other recovery services for the same claim while working with us
• Comply with all applicable laws and regulations

4. Fees and Payment

Our fee structure is contingency-based:

• We charge a percentage of the recovered amount as specified in your service agreement
• No upfront fees are required
• You only pay if we successfully recover funds on your behalf
• All fees are clearly disclosed before you authorize our services
• Payment is deducted from recovered funds before remittance to you

5. No Guarantee of Recovery

While we work diligently on your behalf, we cannot guarantee successful recovery of unclaimed property. Recovery depends on various factors including eligibility verification, proper documentation, and government agency approval. We will make reasonable efforts to pursue all valid claims.

6. Confidentiality

We maintain strict confidentiality of all client information and documents. Your personal and financial information will only be shared as necessary to process your claim and as required by law. Please refer to our Privacy Policy for detailed information about data handling.

7. Authorization and Power of Attorney

By engaging our services, you authorize CollectRefund to act as your representative in pursuing unclaimed property claims. This may include executing limited powers of attorney or other authorization documents required by government agencies.

8. Term and Termination

Either party may terminate the service agreement with written notice. However:

• If we have already submitted a claim on your behalf, our fee obligation continues for that claim
• You are responsible for fees on any claims successfully recovered within 12 months of termination that we initiated
• We will return all original documents upon termination

9. Limitation of Liability

CollectRefund shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the fees paid to us for the specific claim in question.

10. Dispute Resolution

Any disputes arising from these Terms of Service shall be resolved through:

• Good faith negotiation between the parties
• Mediation, if negotiation fails
• Binding arbitration in accordance with the rules of the American Arbitration Association

The laws of the State of California shall govern these terms.

11. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of CollectRefund and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

13. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
